PAIA Manual
Manual in terms of section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA), read with the Protection of Personal Information Act, 4 of 2013 (POPIA)

Why this exists: PAIA gives every person the right to request access to records held by a private body where the record is required for the exercise or protection of a right. Since 1 January 2022 all private bodies carrying on business, however small, must make this manual available. It is published on our website and available for inspection at our principal place of business.

2. The Regulator's Guide on how to use PAIA (section 10)
The Information Regulator has published a Guide, in all official languages, explaining how to use PAIA. 3. Records automatically available (no PAIA request needed)
Published freely on www.oldtreeyard.co.za: product listings and prices; the Store Information & Terms of Sale; the Returns, Refunds & Cooling-Off Policy; the Privacy Notice; and this manual. Customers also automatically receive the full record of their own transactions by email.
4. Records held in terms of other legislation
- Financial and accounting records (Tax Administration Act and Income Tax Act)
- Sales and transaction records (Consumer Protection Act and ECTA)
- Personal information processing records (POPIA)
- Complaint records (Consumer Goods and Services Industry Code)
5. Categories of records we hold
Customers and sales: orders, invoices, delivery and tracking records, returns and refunds, support correspondence, complaint records.
Financial: accounting ledger, bank records, Payfast settlement records, management accounts, tax records.
Suppliers and stock: supplier invoices and correspondence, purchase orders, goods-received records, inventory and repacking batch records.
Marketing: newsletter subscriber list (opt-in), published content.
Business: the founders' services agreement and internal policies.
Personnel: none; the business currently has no employees.
6. How to request access to a record
- Use PAIA Form 2 (Request for Access to Record of Private Body), available from the Information Regulator's website (inforegulator.org.za, under PAIA forms) or from us on request.
- Send the completed form to the Information Officer at wesley@oldtreeyard.co.za or 23 Sunbirdway, 1 Fish Eagle Drive, Hilltop Estate, Ballito, KwaZulu-Natal, 4420, South Africa.
- Identify the record clearly, state which right you are seeking to exercise or protect and why the record is required for it, and state the form of access you want (copy, inspection, electronic).
- If you're asking on someone else's behalf, include proof of authority.
Fees: the prescribed request fee for private bodies as published in the applicable PAIA Regulations from time to time plus prescribed access and reproduction fees where applicable. A person requesting their own personal information pays no request fee.
Timing: we will decide on the request and notify you within 30 days of receiving it, as PAIA requires (extendable once by up to 30 days in the circumstances the Act allows). Access may be refused only on the grounds listed in Chapter 4 of Part 3 of PAIA (for example, protection of another person's privacy or the commercially confidential information of a third party); any refusal will state the reasons and your remedies.
If refused: you may complain to the Information Regulator (PAIAComplaints@inforegulator.org.za; complaint forms are on their website) or apply to court.
7. Your POPIA rights over your own information
Separate from PAIA, POPIA lets you ask us at any time, informally and with no form needed, to confirm what personal information we hold about you, to correct or delete it, and to object to certain processing or withdraw consent for direct marketing (sections 23-25 of POPIA). Details are in our Privacy Notice. We resolve most such requests within a few business days, free of charge.
8. Availability of this manual
This manual is available on www.oldtreeyard.co.za, for inspection at 23 Sunbirdway, 1 Fish Eagle Drive, Hilltop Estate, Ballito, KwaZulu-Natal, 4420, South Africa during business hours by arrangement, and from the Information Regulator on request. It is reviewed and updated whenever our details or record categories change, and at least annually.
